The National Labor Relations Board has scheduled an election for early next month for members of the Dartmouth College men’s varsity basketball team to vote on union representation.
The election will take place March 5 from 11:30 a.m. to 1 p.m. At the close of the election, the ballots will be counted, and given the size, the results should quickly be available, according to the NLRB.
The election will proceed even as Dartmouth College plans to appeal a finding by the Boston regional director of the NLRB, who in early February decided that the 15 members of the Dartmouth team were employees and could therefore decide to unionize.
NLRB rules allow union elections to take place even if a union drive is being challenged on appeal.
Team members of the 2023-24 season are eligible to vote, the NLRB said. All managers, guards, professional employees and supervisors cannot vote.
The Service Employees International Union, which represents hundreds of Dartmouth College employees, hopes to represent the players.
Dartmouth has rejected the idea the players are employees. But the NLRB said many aspects of the Dartmouth player situation point to them being employees. The team generates revenue. The college has significant control over their work. They cannot play basketball for another program. And they receive compensation such as basketball shoes, game tickets, sports medicine and an early read on scholarships.
The election will be held at the college’s Human Resources Office, 7 Lebanon St., Hanover. The vote will be four days before their final regular-season game, at home, against Harvard University.
